For drug addicts, drugs are a “human right” according to the ECtHR

young-drug-addict-livianaThe series of incredible “landmark rulings” emanating from the European Human Rights Court seems to be never ending.

Today a chamber of the Court has unanimously passed a judgment according which a prisoner with drug addiction has a “human right” to get methadone as a “substitution therapy”. Refusing the supply of such a substitute drug would be tantamount to “torture and inhuman treatment”, and hence violate Article 3 of the European Human Rights Convention, even though the Court itself recognizes that it was not established  whether the applicant in fact needed drug substitution therapy.
